Prior to running his own legal practice, Lawrence held Partner and Associate positions at leading litigation and business law firms based in New York City and Long Island. Lawrence’s experience here included spearheading complex litigation matters, construction and labor law cases, business and commercial litigation, premises and product liability, and environmental and toxic torts.

Lawrence received his law degree from Quinnipiac University School of Law, with an undergraduate degree in Finance from the State University at Albany. Recent studies indicate that approximately 40% of people reaching age 65 will require some type of long-term care. In NY State, the annual cost of nursing home care ranges from approximately $135,000 to over $200,000 per year. Although most seniors would prefer to stay at home and hire home health aides, the cost of care for companions or personal care aides could easily eclipse that of a nursing home.
Unfortunately, Medicare does not cover the cost of long-term care, regardless of whether it is at home, in an assisted living community or in a nursing facility. New York’s high cost for nursing home care or home health aides has made Medicaid long-term care planning critically important for seniors and their families at all income levels.
Medicaid is a government benefit program that provides coverage for medical expenses and long-term care for people with medical needs and who meet certain financial criteria. It is ideal to perform preventative Medicaid Planning at least 5 years before the potential Medicaid applicant becomes ill and requires assistance. However, there are several techniques and strategies to help protect lifelong assets even if a person is unable to wait the 5 year “look back period”.
Although planning during a crisis is not optimal, by strategically acting when a crisis occurs, families can often be helped to preserve a large percentage of their assets despite not performing any prior planning. The rules surrounding Medicaid have become more restrictive and complex as pertains to eligibility requirements, look back periods, income caps and uncompensated transfer penalties.

No one likes to think about illness, disability or death, but they are unavoidable parts of growing old. You and your loved ones will be saved from trouble and grief by planning now for inevitable life events. Comprehensive Estate Planning includes protection and preservation of assets – and preservation of a person’s dignity. A comprehensive Estate Plan can have many components, however there a few basic essentials that every estate plan must include. Every Estate Plan must include Advance Directives which will allow you to select the person who will make important healthcare and financial decisions for you in the event that you are unable to do so for yourself due to incapacity. Your Advance Directive documents will include a Healthcare Proxy, Living Will and a Durable Power of Attorney.
In addition to the Advance Directives, every comprehensive Estate Plan should include a Last Will & Testament which will allow you to determine the beneficiaries of your estate and who your executor will be to administer your estate. It will also allow you to establish trusts for a loved one so that your assets are held for them in a protected way.
Probate and Estate Administration
Probate is the court process in which the terms of a decedent’s will are presented to the Surrogate’s Court for validation. If the Petition for probate is approved, Letters Testamentary are granted to the Executor, who will then be in charge of the administration of the decedent’s estate. The Executor will be responsible for distribution of assets, property and possessions after all debts are paid. In a probate proceeding, the Executor is responsible for:
- Locating and making an inventory of all property and transferring it to the estate;
- Paying outstanding bills and taxes;
- Collecting debts owed to the estate;
- Investing and managing assets during the probate proceeding; and
- Distribution of property to beneficiaries at the end of the probate proceeding.
If an individual dies without a will, the court permits a family member or friend to submit a petition to serve as Administrator to distribute the decedent’s estate in accordance with the New York State intestacy laws. Both probate and estate administration proceedings are open to public viewing and can be very complex and time consuming, especially if there is litigation concerning contested issues.
